Yalmakan Administration Responsibilities: What the Condominium Rules Actually Require

Sometimes understanding what is happening today requires looking back at how we got here.

Many of our owners today may not know the history of Yalmakan, the hotel operators, and why those relationships matter.

So, here is a little Yalmakan history lesson.

For years, questions have been raised about who handles maintaining, operating, repairing, and administering YALMAKAN in Cancun.

Fortunately, those responsibilities do not have to be guessed.

They were written down.

YALMAKAN has formal Condominium and Administration Regulations governing the property at Boulevard Kukulcan, Km 19.5, Cancun.

Those regulations show responsibilities for the Administrator, Surveillance Committee, Owners Assembly, and individual condominium owners.

They also distinguish common property from privately owned condominium units.

Therefore, this article is not based upon what Tim's Ocean Condos believes YALMAKAN Administration should do.

It explains what YALMAKAN's own governing documents say Administration is supposed to do.

YALMAKAN Is a Condominium, Not Simply a Hotel

Understanding YALMAKAN begins with understanding its legal structure.

The regulations divide YALMAKAN into common property and exclusive individual property.

Common property includes areas and property providing common services to condominium owners.

It also includes property needed for security, comfort, appearance, recreation, and other community needs.

Meanwhile, individual condominiums are privately owned.

Each condominium owner has exclusive ownership rights over their individual unit.

That distinction becomes extremely important when figuring out responsibility.

An owner handles many matters involving their private condominium.

However, one individual owner cannot be expected to operate and maintain YALMAKAN's common property.

That responsibility is addressed separately within YALMAKAN's governing documents.

 

What Is YALMAKAN Administration Responsible For?

An entire chapter of the YALMAKAN regulations is devoted to Administration.

Article 53 establishes that YALMAKAN is administered by a person or entity designated by the General Assembly.

Article 56 then provides an extensive list of the Administrator's powers and obligations.

These responsibilities go far beyond collecting maintenance fees.

  1. YALMAKAN's Common Property Must Be Managed

The Administrator is charged with guarding and overseeing YALMAKAN's common property.

Its proper use must also be promoted.

This places the management of shared condominium property squarely within the Administration structure.

That matters because YALMAKAN has many areas and systems serving more than one privately owned condominium.

 

  1. General Facilities and Services Must Be Operated

Article 56 assigns responsibility for the:

“attention and operation of the general facilities and services of the Condominium.”

This is one of the clearest provisions in the regulations.

Administration's responsibilities are not limited to paperwork, assessments, or accounting.

YALMAKAN's general facilities and services are specifically addressed within the Administrator's duties.

 

  1. YALMAKAN's Buildings Must Be Preserved

Administration is also charged with acts necessary for the administration and preservation of the buildings comprising the condominium.

That provision should be considered alongside other sections addressing common expenses.

The regulations identify expenses for conservation, maintenance, and repair of common property.

General common-area expenses are also included.

Additionally, expenses involving necessary supplies for conservation, maintenance, cleaning, and property services are contemplated.

Reserve funds for maintenance and Administration are also addressed.

Therefore, preservation of the property is not merely an informal expectation.

It is embedded within YALMAKAN's governing structure.

 

  1. Necessary Repairs Are Part of the Administrative Structure

The regulations specifically address repairs required for preservation of the property.

That becomes particularly important when a problem involves common property rather than an individual condominium.

The regulations also distinguish between ordinary necessary repairs and larger projects requiring Assembly involvement.

Historically, that process can be seen clearly.

In 2016, YALMAKAN's Administrator presented owners with a major project involving remodeling, repair, and renovation of communal areas.

The Owners Assembly then considered the project.

This provides a real example of the governance structure being used.

Administration identified and presented common-property work.

The Assembly considered the project and its funding.

 

  1. Maintenance and Administration Funds Must Be Managed

YALMAKAN owners contribute money toward common condominium expenses.

The regulations establish several categories of those expenses.

They include:

  • Conservation, maintenance, and repair of common property
  • Salaries and services benefiting condominium owners
  • General expenses involving communal areas
  • Utilities associated with Administration and condominium operations
  • Supplies required for maintenance, conservation, cleaning, and property services
  • Maintenance and Administration reserves
  • Equipment and machinery replacement
  • Other authorized common expenses

Therefore, maintenance assessments serve specific condominium purposes.

Administration is responsible for managing those funds within the governing structure.

 

  1. YALMAKAN Owners Are Entitled to Financial Accountability

Article 56 contains detailed financial responsibilities.

Accounting must be maintained for movements involving condominium funds.

Receipts must be provided for owner payments.

More importantly, the Administrator is required to provide each condominium owner with a monthly statement of account.

That statement is supposed to show important financial information.

It includes prior-month expenses.

It includes outstanding owner balances.

Maintenance and Administration fund balances are addressed.

Reserve-fund information is also required.

This is an important part of condominium governance.

Financial reporting to owners is contemplated by YALMAKAN’s own regulations.

 

  1. Administration Must Maintain Records

Administration is also responsible for maintaining books and condominium documentation.

Accounting records must be maintained.

Contracts involving condominium maintenance services are also contemplated within Administration's records.

The regulations further require information concerning pending matters and Administration responsibilities to be maintained.

These requirements become particularly important when Administrators change.

The condominium's responsibilities continue even when the individual Administrator changes.

 

  1. YALMAKAN Must Be Insured

Insurance is another specifically identified responsibility.

The Administrator is directed to obtain insurance for the property.

The regulations address insurance covering the entire property for its destructive value.

They also address what happens following a casualty.

Insurance proceeds are intended to be applied toward restoration.

Therefore, condominium-wide insurance is another responsibility specifically addressed by YALMAKAN's governing documents.

 

  1. Health and Sanitary Requirements Must Be Followed

Article 56 also requires compliance with applicable sanitary provisions.

This responsibility belongs to the Administration section of the regulations.

Again, Administration's role extends beyond collecting money and holding meetings.

Property operation carries additional responsibilities.

 

  1. Owners’ Assembly Decisions Must Be Carried Out

The Owners Assembly makes important condominium decisions.

However, those decisions still need to be implemented.

Article 56 assigns the Administrator responsibility for executing Assembly agreements unless another person has been designated.

This creates an important distinction.

The Assembly decides certain matters. Administration carries those decisions out.

 

Who Watches YALMAKAN Administration?

YALMAKAN's governing documents do not leave Administration without oversight.

A separate Vigilance Committee (Comité de Vigilancia), or Surveillance Committee, is established each year.

Its responsibilities include determining whether the Administrator is complying with the Condominium Law, governing documents, and Assembly resolutions.

The committee also reviews financial information.

Reserve-fund investments can be reviewed.

Administrative observations can be presented to the Owners Assembly.

Complaints and concerns can also move through this governance structure.

Therefore, YALMAKAN Administration is subject to oversight.

 

What Is the YALMAKAN Owners Assembly Responsible For?

The General Owners Assembly has substantial authority.

Among its responsibilities, the Assembly can review annual financial statements submitted by the Administrator.

Annual budgets can be considered and approved.

Owner contributions toward maintenance and Administration can be established.

Reserve funding can also be established.

Funding for equipment and machinery can be considered.

Additionally, the Assembly can instruct the Administrator concerning matters assigned under YALMAKAN's governing documents.

This means the Owners’ Assembly is not simply an informational meeting.

It is a fundamental part of YALMAKAN's governance.

 

YALMAKAN Administration and the Hotel Operator Are Not the Same Thing

This distinction is extremely important.

Historically, YALMAKAN has had a Condominium Administrator and a separate hotel operator.

The 2016 documents demonstrate that separation particularly clearly.

During May 28, 2016, Owners Assembly, Atelier de Hoteles and Nazzareno Holding were presented for ratification.

The owners then unanimously ratified those companies as the exclusive hotel operators of YALMAKAN.

The Condominium Administrator remained a separate role.

That Administrator continued handling responsibilities involving condominium Administration, common property, budgets, maintenance, and Assembly decisions.

Therefore:

YALMAKAN Administration and YALMAKAN's hotel operator should not automatically be treated as the same entity or responsibility.

That distinction becomes especially important whenever hotel operators change.

 

What Happens When the Hotel Operator Changes?

YALMAKAN has operated under different hotel brands and operators throughout its history.

However, changing a hotel operator does not erase the condominium structure.

YALMAKAN remains governed through its condominium documents.

In 2016, the hotel operators were formally presented to owners and ratified by the Owners Assembly.

The adopted rules then specifically referred to hotel operations being exclusive to Atelier and Nazzareno according to that ratification.

That historical record demonstrates why documentation matters whenever responsibilities are transferred between operators.

Questions about a current operator's authority, contractual responsibilities, or services should be answered through the governing documents and applicable Assembly records.

They should not be answered through assumptions.

 

What About Services Previously Provided by a Hotel Operator?

Another distinction must be understood.

At various times, hotel operators may provide or subsidize services benefiting the larger property.

However, the service being provided by an operator does not automatically establish its permanent legal responsibility.

The governing documents, Assembly resolutions, and applicable operating agreements must be examined.

This becomes particularly important following an operator change.

Owners should be able to determine who is responsible for each service: YALMAKAN Administration, the hotel operator, individual condominium owners, or another contracted provider.

What Are Individual YALMAKAN Owners Responsible For?

Certain pipes, systems, fixtures, and other property serving only an individual condominium may also belong to that owner.

Therefore, not every maintenance problem at YALMAKAN automatically becomes an Administration responsibility.

The critical question is often whether the problem involves private property or common property.

 

Where Does Tim's Ocean Condos Fit into This?

Tim's Ocean Condos manages privately owned penthouses for participating owners.

That is a vacation rental management function.

Reservations can be made.

Guest communication can be handled.

Pricing and advertising can be managed.

Housekeeping can be coordinated.

Individual penthouse inspections and guest services can also be provided.

However, managing a vacation rental Cancun property does not make Tim's Ocean Condos the Condominium Administrator.

Tim's Ocean Condos cannot simply assume authority over YALMAKAN's common property.

Likewise, condominium-wide infrastructure cannot necessarily be repaired or altered by an individual vacation rental manager.

This distinction can sometimes be frustrating for guests.

A problem may be reported at once to Tim's Ocean Condos.

However, when that problem originates from common condominium infrastructure, YALMAKAN Administration may need to become involved.

 

Who Is Responsible? Start With the Property Involved

Responsibility should not be decided by who receives the complaint first.

Instead, the underlying problem should be found.

If something belongs exclusively to a privately owned condominium, responsibility may rest with that owner.

If something involves YALMAKAN's common property, general facilities, or condominium services, the Administration provisions become relevant.

If something involves hotel operations, the hotel operator's responsibilities must be examined.

If something involves a privately managed vacation rental, the property's owner or vacation rental manager may be responsible.

These are separate roles.

Why YALMAKAN's Governing Documents Matter

YALMAKAN has existed for decades.

Hotel names have changed.

Hotel operators have changed.

Administrators have changed.

Individual owners have changed.

However, questions concerning responsibility should not be left unanswered.

When an owner asks who is responsible for a common area, building system, repair, service, or expense, a clear answer should be available.

If the responsibility belongs to YALMAKAN Administration, that should be explained.

If it belongs to the hotel operator, that should be explained.

If it belongs to an individual owner or another provider, that should also be explained.

Owners should not be left trying to determine responsibility on their own.

YALMAKAN's governing documents provide an important starting point for finding those answers.

YALMAKAN's Condominium Regulations set up responsibilities, procedures, financial requirements, and oversight.

They identify duties assigned to Administration.

They establish authority belonging to the Owners Assembly.

They create oversight through the Surveillance Committee.

They distinguish common property from privately owned property.

And historical Assembly records prove that hotel operation has been treated separately from condominium Administration.

Those distinctions matter.

When questions arise about YALMAKAN's communal areas, maintenance, repairs, finances, general facilities, services, or Administration, owners deserve clear answers.

Fortunately, many of those answers were written down years ago.
